The use of this website indicates your acceptance of the terms and conditions of use laid down by Congenial Diamonds.
By using the website, you confirm that you are at least 18 years old or that you have the authority and or consent of your parents/guardians to do so. In the terms and conditions stated below, the words ‘company’, ‘we’ and ‘us’ refer to "Congenial Diamonds”, whereas ‘You’, ‘client’ and ‘buyer’ refer to the individual placing the order. We reserve the right to change the terms and conditions at any given point in time. Any such changes will take effect from when they are posted on the site. It becomes your sole responsibility to visit them. Your continued use of the website indicates your acceptance of the updated terms and conditions. The images displayed on the website may not show the actual size of the products. All sizes, weights and measurements are approximate and are for guidance only.
Orders placed on congenialdiamonds.co.uk will be subject to acceptance in accordance to the terms and conditions. On placing the order and checking out, you are making an offer to accept the goods at the stated price subject to the terms and conditions. On acceptance, we will send you an order acknowledgement which will have all your order details agreed by you at the time of placing the order. However, such acknowledgement will not be treated as a binding contract and the order will not be treated as ‘accepted’ for the following reasons:
- Payment not authorized;
- Partial payment pending;
- Error on the website with respect the stated price amount;
- Order being cancelled.
Your order is an offer to purchase which, if accepted, will result in a binding contract. Your offer to purchase is accepted by Congenial Diamonds, when you receive an email with order accepted.
Free Next Day delivery applies only to those products advertised as “Free Next Day Delivery”. All efforts will be made to dispatch and deliver the products within the stipulated timescale; however, delays could be inevitable due to unforeseen circumstances. Wherever possible, we will keep you updated about any such delays at all times and inform you about the rescheduled delivery date. We will not be held responsible for any loss you may suffer on account of late delivery or cancellation of your order. If you have any questions regarding your delivery, you can contact our Customer Services. Delivery outside of the UK will be sent by a secure courier and could be liable for additional charges. Pricing and payment
Prices shown are inclusive of VAT and Packaging and Delivery charges, where applicable. Full payment is required at the time that the order is placed. We accept all major credit cards and debit cards (including Master Card, Visa, Maestro and American Express). Products are not shipped until and unless complete payment is received for the order placed.
Every product from our online collection through our website, apart from the ones mentioned below, can be returned, if unworn and in its original packaging, for a complete refund or replacement within 30 days of the delivery date. If you wish to return an item, you are requested to notify our Customer Services by written instruction within 30 days from the date of delivery. Failure to do so will make the item non-returnable and non-refundable. Returned merchandise sent to our office without prior written instructions to our customer services will not be eligible for a refund. Only items that are unworn and are returned to us in the original packaging and with all the supporting paperwork are eligible for a refund or an exchange. Every product is delivered with a jewellery tag attached. This jewellery tag needs to remain intact (unbroken and undamaged) for the returned item to qualify for a refund/exchange. All items should be returned to us at your cost and must be fully insured for the full amount of the purchase. We require the parcel’s tracking number and the date the parcel was posted. Congenial Diamonds cannot be held responsible for any items that are lost or damaged while being returned to us. The refund will be credited to the same account that the original payment was debited from. Please allow 7-10 days for the funds to appear in your account. The following items are non-returnable and non-refundable:
- Engraved products.
- Bespoke orders designed exclusively for the client. Such orders include items that are not available to be ordered directly from our website and any items ordered by means of giving a sketch, a diagrammatic presentation or a written instruction to Congenial Diamonds.
- Any item that has been re-sized.
- Jewellery which was of the wrong dimensions at the time of ordering.
Note that the 30 day money back policy does not apply to any jewellery purchased at our premises in Guildford, at wedding shows or other exhibitions.
We thoroughly check every product before it is dispatched and we take great care with our packaging. However items can still be damaged in transit. You are requested to inspect your item as soon as it arrives for any defect or damage. If your product is damaged or faulty, you are requested to notify our Customer Services by written instruction, within 30 days from the date of delivery and we shall arrange for replacement. Returned merchandise must be in a new and unused condition. Items showing signs of wear or alteration by the client or any other, or being tampered with other than by Congenial Diamonds, will not be accepted. Every product comes with a coded security tag which needs to be intact. Tearing off or damaging this tag will void your 30-day right of return. Returned merchandise sent to our office without prior written instructions to our customer services will not be eligible for a refund. Items sent to our office without proper and original packaging or shipped beyond the 30-day return period, will not be eligible for a refund.
Congenial Diamonds can carry out ring size adjustments to ensure a perfect fit. If your newly purchased ring needs resizing, you are kindly requested to notify our Customer Services by written instruction. A fee of £40.00 will be charged to cover the cost of adjusting the size of a ring up to a maximum of 2 finger sizes. Greater size adjustments may require additional work and may incur additional charges. Resizing of a ring generally takes up to 10 working days. Please not that fully set diamond rings cannot be resized.
Any personal information entered or submitted through our website is processed by our highly secured servers. Such data is not sold to any third party and all necessary measures are taken to safeguard the obtained data. You agree that we may use the information provided by you in order to conduct appropriate anti-fraud checks. Personal information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information. We will not be hold responsible for any loss or damages you may suffer if a third party procures unauthorized access to any data whilst ordering or browsing the website. We do not keep credit/debit card details on record after the order transaction is complete.
We will do our best to ensure timely delivery of the products as stated at the time that the order is placed. In such a case where an event prevents us delivering the products, we shall strive to contact you in order to reschedule the delivery time. Congenial Diamonds does not warrant or guarantee the delivery date specified in the order confirmation and shall have no liability to you for any loss, damage, expenses or other claims that you may incur as a result of failure of timely delivery. Congenial Diamonds’ total liability will be limited to the total amount paid by the purchaser for the order placed. Congenial Diamonds does not bear any liability arising out of any defects from any design, if any adjustments, alterations or any other modification has been carried out to the products by any third party, who is not authorized by Congenial Diamonds. All applicable regulations and legislations, including all necessary customs, import or other permits to purchase from our website are the responsibility of the purchaser. The importation or exportation of the products displayed on the website may be prohibited by certain national laws. We make no representation and accept no liability in respect of the import or export of the products purchased by the client or any representative. To the fullest extent permitted by ‘Law’, Congenial Diamonds is providing this website on an “AS IS” basis and makes no warranty of any kind, either express or implied, with respect to this website or its contents. We reserve the rights to change any information, price or content and improve the website at any time without any notice. Congenial Diamonds may provide hypertext links to other websites. No responsibility, guarantee or representations of such linked websites can be taken by Congenial Diamonds.
Law and Jurisdiction
These Terms and Conditions do not affect your statutory rights. If any provision in these terms and conditions is prohibited by law or judged by a court to be unlawful, void or unenforceable, the provision shall, to the extent required, be severed and rendered ineffective as far as possible without modifying the remaining provisions and shall not in any way affect any other circumstances of or the validity or enforcement of these terms and conditions. The website, its contents, terms and conditions and contracts shall be governed by and construed in accordance with English Law any disputes not resolved by normal complaints procedure will be resolved exclusively in the courts of England. All images remain the property of Congenial Diamonds, any replication, use or copying of the images without prior permission by Congenial Diamonds will go against the copyright rules and laws. Congenial Diamonds will take legal recourse against the offender. We reserve the right to change at any time these terms and conditions without prior notice to you.
